Sponsored Assembly Bills

AB 254 (Frommer) Brownfields Loan/Grant Program Cleanup (SB 667)
This bill would make technical amendments to clarify the role of the brownfield site designation committee.

AB 780 (Thompson) Mill Assessment Reauthorization
This bill would repeal the sunset provision for the Department of Pesticide Regulation’s mill assessment.

AB 946 (Kelley) Water Rights
This bill would correct deficiencies in the State Water Resources Control Board’s water rights cease and desist order authority, improve water right petition processing, and clarify that Water Code Section 1211 only applies to changes in the discharge or use of treated waste water that result in reduced flow in any portion of the watercourse.

AB 1187 (Simitian) Omnibus Cleanup
This bill would make technical and clarifying changes to various sections of the Integrated Waste Management Act.

AB 1259 (Wiggins) Loss of Authorization/Permit Denial for Non-Payment of Hazardous Waste Fees
This bill would require the Department of Toxic Substances Control (DTSC) to suspend a facilities license to operate for failure to pay fees, authorize the DTSC to revoke or deny a permit for failure to pay fees, and prohibit the DTSC from issuing or renewing a permit for a facility that owes fees. These actions would be stayed until after the completion of a judicial appeal proceeding.

AB 1393 (Thomson) Regional Board Efficiency
This bill would expand the use of hearing panels and pre-hearing conferences for Regional Water Quality Control board members.

AB 1465 (Nation) Omnibus Underground Storage Tank (UST)
This bill would amend the Health & Safety Code to clarify administrative procedures in the Underground Storage Tank law for the State Water Resources Control Board and Underground Storage Tank owners/operators.

AB 1664 (Pavley) Water Quality Enforcement
This bill would clarify and reconcile existing law regarding enforcement procedures relating to non-point sources and discharges to land and water. In addition, this bill would authorize the recovery of staff costs for issuance of Administrative Civil Liabilities and administration of supplemental environmental projects and would provide alternative enforcement options for violations by operators of wastewater treatment plants.

AB 1708 (Assembly Transportation Committee) Authorization for Tow Truck Drivers to Cleanup Small Spills
This bill would allow tow truck drivers to transport small amounts of vehicular fluids released during accidents and temporarily store the waste fluids on company site.

SB 232 (Sher) Brownfields Insurance Program
This bill would create the California Environmental Insurance Program (Envirosure) and the California Environmental Insurance Trust Fund (Envirotrust), to provide affordable environmental insurance for developers of brownfield sites.

SB 470 (Assembly Environmental Safety and Toxic Materials Committee) Hazardous Waste Control Law Cleanup
This bill would correct and clarify statutes, restore the Department of Toxic Substances Control’s ability to suspend a hazardous waste transporter’s registration pending outcome of administrative hearing process and reinstate the disclosure statement requirement for applicants for hazardous waste facility permits.

SB 1011 (Sher) California Environmental Protection Agency Reorganization
This bill would amend Section 12812 of the Government Code in order to implement the recommendations made as a result of the Cal/EPA organizational study report submitted to the Legislature in 1999.

SB 1172 (Kuehl) Improvements to the Enhanced Inspection/Maintenance Program
This bill would repeal the rolling 30-year Smog Check exemption scheduled to begin in 2003 to assist California in meeting its Ozone State Implementation Plan.
